CHAPTER 7 - OF PARTITIONS MADE BY PARENTS AND OTHER ASCENDANTS AMONG THEIR DESCENDANTS

Art. 1724. Fathers and mothers and other ascendants may make a distribution and partition of their property among their children and descendants, either by designating the quantum of the parts and partitions [portions] which they assign to each of them, or in designating the property that shall compose their respective lots. Art. 1725. These partitions may be made by act inter vivos or by testament. If a testator has designated the quantum or value of his estate which he bequeaths to a legatee either by formula or by specific sum, he may expressly delegate to his executor the authority to select assets to satisfy the quantum or value. [Amended by Acts 1982, No. 448, §1]

Art. 1726. Those made by an act inter vivos can have only present property for their object, and are subject to all the formalities and conditions of donations inter vivos.

Art. 1727. Those made by testament must be made in the forms prescribed for acts of that kind, and are subject to the same rules.

Art. 1728. If the partition, whether inter vivos or by testament, has not comprised all the property that the ascendant leaves on the day of his decease, the property not comprised in the partition is divided according to law.

Art. 1729. If the partition, whether inter vivos or by testament, be not made amongst all the children living at the time of the decease and the descendants of those predeceased, the partition shall be null and void for the whole; the child or descendant who had no part in it, may require a new partition in legal form. Art. 1730. Partitions, made by ascendants, may be avoided, when the advantage secured to one of the coheirs exceeds the disposable portion.

Art. 1731. The child who objects to the partition made by the ascendant, must advance the expenses of having the property estimated, and must ultimately support them and the costs of suit, if his claim be not founded.

Art. 1732. The defendant in the action of rescission may arrest it by offering to the plaintiff the supplement of the portion to which he has a right.

Art. 1733. The rescission of the partition does not carry with it the nullity of a donation made as an advantage.

CHAPITRE 7 – DES PARTAGES FAITS PAR LES PARENTS ET AUTRES ASCENDANTS ENTRE LEURS DESCENDANTS

Art. 1724. Les père et mère et autres ascendants peuvent faire entre leurs enfants et descendants la distribution et partage de leurs biens, soit en désignant la quotité des parts et portions qu'ils assignent à chacun d'eux, soit en désignant les biens qui composeront leurs lots. Art. 1725. Ces partages peuvent être faits par actes entre-vifs ou testamentaires. Si le testateur a désigné la quotité ou la valeur de l’héritage qu'il lègue à un légataire, soit par une formule, soit par une somme spécifique, il peut expressément déléguer à son exécuteur le pouvoir de choisir les actifs pour acquitter la quotité ou la valeur. Art. 1726. Ceux faits par actes entre vifs, ne peuvent avoir pour objet que les biens présents, et sont soumis à toutes les formalités et conditions des donations entre vifs. → CC 1825, art. 1719.

Art. 1727. Ceux faits par testament doivent être en la forme prescrite pour ces sortes d'actes, et sont sujets aux mêmes règles → CC 1825, art. 1720.

Art. 1728. Si le partage, soit entre vifs, soit par testament, n'a pas compris tous les biens que l'ascendant laisse au jour de son décès, les biens non compris dans le partage sont divisés conformément à la loi → CC 1825, art. 1721

Art. 1729. Si le partage, soit entre vifs, soit par testament, n'est pas fait entre tous les enfants, qui existeront à l'époque du décès, et les descendants de ceux prédécédés, le partage sera nul pour le tout ; l'enfant ou descendant, qui n'aura pas eu part, en pourra provoquer un nouveau en la forme légale. Art. 1730. Le partage fait par l'ascendant, peut être attaqué*, lorsque l'avantage fait à l'un des cohéritiers, excède la portion disponible. → CC 1825, art. 1723.

Art. 1731. L'enfant qui attaque le partage fait par l'ascendant, doit avancer les frais de l'estimation, et doit les supporter en définitive, ainsi que les dépens de la contestation, si la réclamation n'est pas fondée. → CC 1825, art. 1724.

Art. 1732. Le défendeur en rescision peut arrêter l'action en offrant au demandeur le supplément de portion auquel il peut avoir droit. → CC 1825, art. 1725.

Art. 1733. La rescision de partage n'entraine pas la nullité du don fait à titre d'avantage. → CC 1825, art. 1726.
