SECTION 4 - OF THE TUTORSHIP BY THE EFFECT OF THE LAW

Art. 263. When a tutor has not been appointed to the minor by father or mother dying last, or if the tutor thus appointed has not been confirmed or has been excused, then the judge shall appoint to the tutorship, from among the qualified ascendants in the direct line, collaterals by blood within the third degree and the surviving spouse of the minor's mother or father dying last, the person whose appointment is in the best interests of the minor. SECTION 5 - OF DATIVE TUTORSHIP

Art. 270. When a minor is an orphan, and has no tutor appointed by his father or mother, nor any relations who may claim the tutorship by effect of law, or when the tutor appointed in some of the modes above expressed is liable to be excluded or disqualified, or is excused legally, the judge shall appoint a tutor to the minor. SECTION 6 - OF THE UNDERTUTOR

Art. 273. In every tutorship there shall be an undertutor. [Amended by Acts 1960, No. 30, §1, eff. Jan. 1, 1961]

Art. 278. The undertutor who fails or neglects to cause to be inscribed in the manner required by law, the evidence of the minor's legal mortgage against his tutor, shall be liable for all the damages which the minor may sustain in consequence of such failure or neglect; and this claim for damages shall not be prescribed so long as the minor's right of action exists against his tutor.

Art. 280. The duties of the undertutor are at an end at the same time with the tutorship.

SECTION 7 - OF FAMILY MEETINGS

SECTION 8 - OF THE CAUSES WHICH DISPENSE OR EXCUSE FROM THE TUTORSHIP

Art. 292. The following persons are dispensed or excused from the tutorship by the privilege of their offices or functions:

1.  The Governor and the Secretary of State;

2.  The judges of the different courts of this State and the officers of the same;

3.  The Mayor of the city of New Orleans;

4.  The Collector of the Customs;

5.  The officers and soldiers attached to the regular troops, whether on land or sea service, employed and in actual service in this State, and all the officers who are intrusted in this State with any mission from the Government, as long as they are employed;

6.  Preceptors and other persons keeping public schools, as long as they remain in the useful and actual exercise of their profession;

7.  Ministers of the gospel.

Art. 293. The persons mentioned in the preceding article, who have accepted a tutorship posterior to their being invested with the offices, engaged in the service, or intrusted with the mission which dispenses from it, shall not be admitted to be excused on that account.

Art. 294. Those, on the contrary, who shall have been invested with offices, who shall have engaged in the service, or shall have been intrusted with commissions, posterior to their acceptation and administration of a tutorship, may, if they do not choose to continue to act as tutor, be excused from the tutorship, and apply for the appointment of another tutor to supply their place.

Art. 295. No person, who is not a relation of the minor by consanguinity, or who is only related to him beyond the fourth degree, can be compelled to accept the tutorship.

Art. 296. Every person who has attained the age of sixty-five years, may refuse to be a tutor.

The person who shall have been appointed prior to that age, may be excused from the tutorship at the age of seventy years.

Art. 297. Every person affected with a serious infirmity, may be excused from the tutorship, if this infirmity be of such nature as to render him incapable of transacting his own business.

He may even be discharged from the tutorship, if such infirmity has befallen him after his appointment.

Art. 298. The person who is appointed to two tutorships has a legal excuse for not accepting a third.

A parent who has been appointed to one tutorship shall not be compelled to accept a second tutorship, except it be that of his own children. [Amended by Acts 1974, No. 163, §3]

Art. 299. The tutor, who has excuses to offer against his appointment, must propose them to the judge who has appointed him, within ten days after he has been acquainted with his appointment, or after the same shall have been notified to him, which period shall be increased one day for every ten miles distance from his residence to the place where his appointment was made, and after this delay he shall no longer be admitted to offer any excuse, unless he has sufficient reason to account for such delay.

Art. 300. During the time of the pendency of the litigation relative to the validity of his excuses, the tutor who is appointed shall be bound provisionally to administer as such, until he shall have been regularly discharged.

Art. 301. The causes herein expressed, or any other, cannot excuse a parent from the obligation of accepting the tutorship of his children. [Amended by Acts 1974, No. 163, §3]

SECTION 4 - DE LA TUTELLE LÉGITIME

Art. 263. Lorsqu’il n’a pas été choisi au mineur un tuteur par le dernier mourant de ses père et mère, ou si ce tuteur n’a pas été confirmé ou a été excusé, le juge doit déférer la tutelle à la personne compétente dont le choix sert au mieux l’intérêt du mineur, parmi les ascendants en ligne directe, les collatéraux par le sang jusqu’au troisième degré et le conjoint survivant du dernier mourant de ses père et mère. SECTION 5 - DE LA TUTELLE DATIVE

Art. 270. Lorsqu’un mineur restera sans père ni mère, ni tuteur élu par ses père et mère, ni parents qui puissent réclamer sa tutelle légitime, comme aussi le tuteur de l’une des qualités ci-dessus exprimées, se trouvera exclu ou destitué, ou valablement excusé, il sera pourvu par le juge à la nomination d’un tuteur au mineur. SECTION 6 - DU SUBROGÉ TUTEUR

Art. 273. Dans toute tutelle il y a un subrogé tuteur. [Modifié par la loi de 1960, n° 30, §1, en vigueur au 1er janvier 1961] → CC 1825, art. 300

Art. 278. Le subrogé tuteur, qui manque ou néglige d’effectuer l’inscription de la preuve de l’hypothèque légale du mineur contre son tuteur dans les formes prévues par la loi, est responsable pour tout dommage que le mineur pourrait subir suite à ce manquement ou cette négligence. Cette action en dommages-intérêts ne se prescrit pas tant que perdure le droit d’action du mineur contre son tuteur.

Art. 280. Les fonctions du subrogé tuteur cessent à la même époque que la tutelle. → CC 1825, art. 304

SECTION 7 - DE L’ASSEMBLÉE DE FAMILLE

SECTION 8 - DES RAISONS QUI DISPENSENT OU EXCUSENT DE LA TUTELLE

Art. 292. Sont dispensés ou excusés de la tutelle par leurs places ou fonctions :

1. Le gouverneur et le secrétaire d’État ;

2. Les juges des différentes cours de l’état et les divers officiers de ces cours ;

3. Le maire de la ville de La Nouvelle-Orléans ;

4. Le collecteur de la douane ;

5. Les militaires attachés aux corps des troupes de ligne ou de la marine employés dans cet état et en activité de service, et tous autres officiers qui remplissent momentanément dans cet état quelques missions du gouvernement, tandis qu’ils sont en exercice ;

6. Les précepteurs et autres personnes tenant des écoles publiques en cet état, tant qu’ils restent dans l’exercice utile et réel de leurs fonctions ;

7. Les ministres du culte. → CC 1825, art. 312

Art. 293. Les personnes des qualités exprimées en l’article précédent, qui ont accepté la tutelle postérieurement aux fonctions, services ou missions qui en dispensent, ne seront plus admises à s’en faire décharger pour cette cause. → CC 1825, art. 313

Art. 294. Ceux au contraire à qui ces fonctions, services ou missions auront été confiés postérieurement à l’acceptation et gestion d’une tutelle, pourront, s’ils ne veulent pas la conserver, s’en faire décharger, et requérir la nomination d’un tuteur pour les remplacer. → CC 1825, art. 314

Art. 295. Tout individu, non apparenté au mineur par le sang, ou qui n’en est parent qu’au-delà du quatrième degré, ne peut être forcé d’accepter la tutelle. → CC 1825, art. 315

Art. 296. Tout individu âgé de soixante-cinq ans accomplis peut refuser d’être tuteur.

Celui qui aura été nommé avant cet âge, pourra, à soixante-dix ans, se faire décharger de la tutelle. → CC 1825, art. 316

Art. 297. Tout individu atteint d’une infirmité grave pourra s’excuser de la tutelle, si cette infirmité est de nature à le rendre incapable de vaquer à ses propres affaires.

Il pourra même s’en faire décharger, si cette infirmité est survenue depuis sa nomination. → CC 1825, art. 317

Art. 298. Deux tutelles sont pour toute personne une juste dispense d’en accepter une troisième.

Un parent qui est chargé d’une tutelle ne peut être tenu d’en accepter une seconde, excepté celle de ses enfants. [Modifié par la loi de 1974, n° 163, §3] → CC 1825, art. 318

Art. 299. Le tuteur qui aura des excuses à faire valoir contre sa nomination, sera tenu de les proposer au juge qui l’a nommé, dans les dix jours de la connaissance qu’il aura eue de sa nomination, ou de la notification qui lui en aura été faite, lequel délai sera augmenté d’un jour pour chaque dix miles de distance du lieu de sa résidence à celui de l’ouverture de la tutelle* ; passé ce délai, il sera déclaré non recevable, s’il n’a de bonnes raisons pour se justifier de ce retard. → CC 1825, art. 319

Art. 300. Pendant la durée du litige pour faire admettre ses excuses, le tuteur nommé sera toujours tenu d’administrer* en cette qualité, jusqu’à ce qu’il ait été régulièrement déchargé. → CC 1825, art. 320

Art. 301. Les causes exprimées ci-dessus, ni aucune autre, ne peuvent dispenser un parent de l’obligation de se charger de la tutelle de ses enfants. [Modifié par la loi de 1974, n° 163, §3] → CC 1825, art. 321
