CHAPTER 4 - TERMINATION AND DISSOLUTION

SECTION 1 - RULES APPLICABLE TO ALL LEASES

Art. 2714. If the leased thing is lost or totally destroyed, without the fault of either party, or if it is expropriated, the lease terminates and neither party owes damages to the other. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2715. If, without the fault of the lessee, the thing is partially destroyed, lost, or expropriated, or its use is otherwise substantially impaired, the lessee may, according to the circumstances of both parties, obtain a diminution of the rent or dissolution of the lease, whichever is more appropriate under the circumstances. If the lessor was at fault, the lessee may also demand damages.

If the impairment of the use of the leased thing was caused by circumstances external to the leased thing, the lessee is entitled to a dissolution of the lease, but is not entitled to diminution of the rent. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2716. A lease granted by a usufructuary terminates upon the termination of the usufruct.

The lessor is liable to the lessee for any loss caused by such termination, if the lessor failed to disclose his status as a usufructuary. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2717. A lease does not terminate by the death of the lessor or the lessee or by the cessation of existence of a juridical person that is party to the lease. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2718. A lease in which one or both parties have reserved the right to terminate the lease before the end of the term may be so terminated by giving the notice specified in the lease contract or the notice provided in Articles 2727 through 2729, whichever period is longer. The right to receive this notice may not be renounced in advance. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2719. When a party to the lease fails to perform his obligations under the lease or under this Title, the other party may obtain dissolution of the lease pursuant to the provisions of the Title of "Conventional Obligations or Contracts". [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

SECTION 2 - LEASES WITH A FIXED TERM

Art. 2720. A lease with a fixed term terminates upon the expiration of that term, without need of notice, unless the lease is reconducted or extended as provided in the following Articles. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2721. A lease with a fixed term is reconducted if, after the expiration of the term, and without notice to vacate or terminate or other opposition by the lessor or the lessee, the lessee remains in possession:

(1) For thirty days in the case of an agricultural lease;

(2) For one week in the case of other leases with a fixed term that is longer than a week; or

(3) For one day in the case of a lease with a fixed term that is equal to or shorter than a week. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2722. The term of a reconducted agricultural lease is from year to year, unless the parties intended a different term which, according to local custom or usage, is observed in leases of the same type. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2723. The term of a reconducted nonagricultural lease is:

(1) From month to month in the case of a lease whose term is a month or longer;

(2) From day to day in the case of a lease whose term is at least a day but shorter than a month; and

(3) For periods equal to the expired term in the case of a lease whose term is less than a day. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2724. When reconduction occurs, all provisions of the lease continue for the term provided in Article 2722 or 2723.

A reconducted lease is terminated by giving the notice directed in Articles 2727 through 2729. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2725. If the lease contract contains an option to extend the term and the option is exercised, the lease continues for the term and under the other provisions stipulated in the option. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2726. An amendment to a provision of the lease contract that is made without an intent to effect a novation does not create a new lease. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

SECTION 3 - LEASES WITH INDETERMINATE TERM

Art. 2727. A lease with an indeterminate term, including a reconducted lease or a lease whose term has been established through Article 2680, terminates by notice to that effect given to the other party by the party desiring to terminate the lease, as provided in the following Articles. Art. 2728. The notice of termination required by the preceding Article shall be given at or before the time specified below:

(1) In a lease whose term is measured by a period longer than a month, thirty calendar days before the end of that period;

(2) In a month-to-month lease, ten calendar days before the end of that month;

(3) In a lease whose term is measured by a period equal to or longer than a week but shorter than a month, five calendar days before the end of that period; and

(4) In a lease whose term is measured by a period shorter than a week, at any time prior to the expiration of that period.

A notice given according to the preceding Paragraph terminates the lease at the end of the period specified in the notice, and, if none is specified, at the end of the first period for which the notice is timely. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

Art. 2729. If the leased thing is an immovable or is a movable used as residence, the notice of termination shall be in writing. It may be oral in all other cases.

In all cases, surrender of possession to the lessor at the time at which notice of termination shall be given under Article 2728 shall constitute notice of termination by the lessee. [Acts 2004, No. 821, §1, eff. Jan. 1, 2005]

CHAPITRE 4 - DE LA FIN ET DE LA RÉSILIATION DU LOUAGE

SECTION 1 - DES RÈGLES APPLICABLES À TOUS LES CONTRATS DE LOUAGE

Art. 2714. En cas de perte ou de destruction totale de la chose louée non imputable aux parties, ou en cas d’expropriation, le bail prend fin, et les parties ne se doivent pas de dédommagement. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2715. Lorsque, en l’absence de faute du preneur, la chose est en partie détruite, perdue ou expropriée, ou si l’usage en est fortement diminué, le preneur peut, compte tenu de la situation de chacune des parties, obtenir une diminution du loyer ou la résiliation du bail, selon ce qui sera jugé le plus approprié. En cas de faute du bailleur, le preneur peut en outre demander des dommages et intérêts.

Lorsque la diminution de l’usage de la chose louée résulte de circonstances extérieures à celle-ci, le preneur a droit à la résiliation du bail mais pas à la diminution du loyer. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2716. Le bail, passé par un usufruitier, finit avec l’usufruit.

Le bailleur est responsable de toute perte résultant de l’extinction de l’usufruit s’il a omis de porter à la connaissance du preneur sa qualité d’usufruitier. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2717. Le bail ne prend fin ni avec la mort du bailleur ou du preneur, ni avec la dissolution d’une personne morale partie au contrat. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2718. Lorsqu’en vertu du bail, une partie ou les deux parties se réservent le droit de mettre fin au bail avant l’expiration du terme, celui-ci peut prendre fin par congé donné selon les modalités prévues au contrat ou aux articles 2727 à 2729, la période la plus longue étant retenue. On ne peut renoncer par avance au droit de recevoir ledit congé. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2719. Lorsqu’une partie manque à ses obligations en vertu du bail ou du présent titre, l’autre partie peut obtenir la résiliation du bail conformément aux dispositions du titre « Des obligations conventionnelles ou des contrats ». [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

SECTION 2 - DES CONTRATS DE LOUAGE À DURÉE DETERMINÉE

Art. 2720. Le bail à durée déterminée prend fin à l’expiration du terme, sans qu’il soit nécessaire de donner congé, sauf si le bail est reconduit ou prolongé dans les conditions prévues aux articles suivants. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2721. Le bail à durée déterminée est reconduit si, à l’expiration du terme, et en l’absence d’une notification de libération des lieux ou de congé, ou de toute autre opposition du bailleur ou du preneur, ce dernier reste en possession :

(1) Pendant trente jours dans le cadre d’un bail rural ;

(2) Pendant une semaine dans le cadre d’autres baux à durée déterminée de plus d’une semaine ; ou

(3) Pendant un jour dans le cadre d’un bail à durée déterminée d’une semaine ou moins. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2722. Le terme d’un bail rural qui a fait l’objet d’une reconduction est fixé à l’année, sauf si les parties sont convenues d’un terme différent qui est observé pour des baux de même nature, selon la coutume ou l’usage des lieux. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2723. Le terme d’un bail non-rural qui fait l’objet d’une reconduction est fixé:

(1) Au mois pour le bail dont le terme est égal ou supérieur à un mois ;

(2) Au jour pour le bail dont le terme est au moins égal à un jour et inférieur à un mois ; et

(3) Pour des périodes égales au terme échu pour le bail dont le terme est inférieur à un jour. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2724. En cas de reconduction, toutes les dispositions du bail continuent à s’appliquer pour le terme prévu aux articles 2722 et 2723.

Un bail ayant fait l’objet d’une reconduction prend fin par congé donné dans les conditions prévues aux articles 2727 à 2729. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2725. Lorsque le contrat de bail contient une option permettant de prolonger le terme et que cette option est levée, le bail se poursuit pour le terme convenu et ce, conformément à ce qui est stipulé dans l’option. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

Art. 2726. La modification d’une clause du contrat de bail faite sans volonté de réaliser une novation ne crée pas un nouveau bail. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]

SECTION 3 - DES CONTRATS DE LOUAGE À DURÉE INDÉTERMINÉE

Art. 2727. Le bail à durée indéterminée, y compris le bail avec reconduction ou le bail dont le terme a été fixé selon l’article 2680, prend fin par congé donné à cet effet à l’autre partie par celle désirant résilier le bail et ce, dans les conditions prévues aux articles suivants. Art. 2728. Le congé requis par l’article précédent doit être donné au moment indiqué ci-dessous ou préalablement à celui-ci :

(1) Pour le bail dont le terme est supérieur ou égal à un mois, trente jours civils avant la fin de ce terme ;

(2) Pour le bail au mois, dix jours civils avant la fin de ce mois ;

(3) Pour le bail dont le terme est supérieur ou égal à une semaine et inférieur à un mois, cinq jours civils avant la fin de ce terme ; et

(4) Pour le bail dont le terme est inférieur à une semaine, à tout moment précédant la fin de ce terme.

Le congé donné conformément aux dispositions du paragraphe précédent met fin au bail à l’expiration de la période indiquée dans le congé, et, à défaut de période spécifiée, à l’expiration de la première période pour laquelle le congé a été dûment donné. Art. 2729. Lorsque la chose louée est un immeuble ou un meuble à usage d’habitation, le congé doit être donné par écrit. Il peut être donné oralement dans tous les autres cas.

Dans tous les cas, la remise de la chose au bailleur, au moment où le congé doit être donné conformément à l’article 2778, vaut congé donné par le preneur. [Loi de 2004, no 821, §1, en vigueur le 1er janvier 2005]
