TITLE VIII - OF EXCHANGE

Art. 2660. Exchange is a contract whereby each party transfers to the other the ownership of a thing other than money.

Ownership of the things exchanged is transferred between the parties as soon as there is agreement on the things, even though none of the things has been delivered.

If it is the intent of the parties that the transfer of ownership will not take place until a later time, then the contract is a contract to exchange. [Acts 2010, No. 186, §1, eff. Aug. 15, 2010]

Art. 2661. Each of the parties to a contract of exchange has the rights and obligations of a seller with respect to the thing transferred by him and the rights and obligations of a buyer with respect to the thing transferred to him. [Acts 2010, No. 186, §1, eff. Aug. 15, 2010]

Art. 2662. A person evicted from a thing received in exchange may demand the value of the thing from which he was evicted or the return of the thing he gave, with damages in either case. [Acts 2010, No. 186, §1, eff. Aug. 15, 2010]

Art. 2663. A party giving a corporeal immovable in exchange for property worth less than one half of the fair market value of the immovable given by him may claim rescission on grounds of lesion beyond moiety. [Acts 2010, No. 186, §1, eff. Aug. 15, 2010]

Art. 2664. The contract of exchange is governed by the rules of the contract of sale, with the differences provided in this Title. [Acts 2010, No. 186, §1, eff. Aug. 15, 2010]

TITRE VIII - DE L’ÉCHANGE

Art. 2660. L'échange est un contrat par lequel chaque partie transfère à l'autre la propriété d'une chose autre que de l'argent.

La propriété des choses échangées est transférée dès qu'il y a accord sur les choses, même si aucune d'entre elles n'a été délivrée.

Lorsque l'intention des parties est de reporter le transfert de propriété à un moment ultérieur, il s'agit d'une promesse d'échange. [Loi de 2010, no 186, §1, en vigueur le 15 août 2010]

Art. 2661. Chaque partie au contrat d'échange a les droits et obligations d'un vendeur à l'égard de la chose qu'il transfère et les droits et obligations d'un acheteur à l'égard de la chose qui lui est transférée. [Loi de 2010, no 186, §1, en vigueur le 15 août 2010]

Art. 2662. La personne évincée d'une chose reçue en échange peut réclamer la valeur de cette chose ou la restitution de la chose qu'il a lui-même donnée, avec des dommages et intérêts dans un cas comme dans l'autre. [Loi de 2010, no 186, §1, en vigueur le 15 août 2010]

Art. 2663. La partie donnant un immeuble corporel en échange d'un bien valant moins de la moitié de la valeur marchande de l'immeuble justement appréciée peut agir en rescision pour lésion d'outre-moitié. [Loi de 2010, no 186, §1, en vigueur le 15 août 2010]

Art. 2664. Sauf disposition contraire du présent titre, le contrat d'échange est régi par les règles relatives au contrat de vente. [Loi de 2010, no 186, §1, en vigueur le 15 août 2010]
