CHAPTER 6 - DISPOSITIONS MORTIS CAUSA

SECTION 1 - TESTAMENTS GENERALLY

Art. 1570. A disposition mortis causa may be made only in the form of a testament authorized by law. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

Art. 1571. A testament may not be executed by a mandatary for the testator. Nor may more than one person execute a testament in the same instrument. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

Art. 1572. Testamentary dispositions committed to the choice of a third person are null, except as expressly provided by law. A testator may delegate to his executor the authority to allocate specific assets to satisfy a legacy expressed in terms of a value or a quantum, including a fractional share.

The testator may expressly delegate to his executor the authority to allocate a legacy to one or more entities or trustees of trusts organized for educational, charitable, religious, or other philanthropic purposes. The entities or trusts may be designated by the testator or, when authorized to do so, by the executor in his discretion. In addition, the testator may expressly delegate to his executor the authority to impose conditions on those legacies. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

Art. 1573. The formalities prescribed for the execution of a testament must be observed or the testament is absolutely null. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

SECTION 2 - FORMS OF TESTAMENTS

Art. 1574. There are two forms of testaments: olographic and notarial. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

Art. 1575. A. An olographic testament is one entirely written, dated, and signed in the handwriting of the testator. Although the date may appear anywhere in the testament, the testator must sign the testament at the end of the testament. If anything is written by the testator after his signature, the testament shall not be invalid and such writing may be considered by the court, in its discretion, as part of the testament. The olographic testament is subject to no other requirement as to form. The date is sufficiently indicated if the day, month, and year are reasonably ascertainable from information in the testament, as clarified by extrinsic evidence, if necessary.

B. Additions and deletions on the testament may be given effect only if made by the hand of the testator. [Acts 1997, No. 1421, §1, eff. July 1, 1999; Acts 2001, No. 824, §1]

Art. 1576. A notarial testament is one that is executed in accordance with the formalities of Articles 1577 through 1580.1. [Acts 1997, No. 1421, §1, eff. July 1, 1999; Acts 1999, No. 745, §1, eff. July 1, 1999]

Art. 1577. The notarial testament shall be prepared in writing and dated and shall be executed in the following manner. If the testator knows how to sign his name and to read and is physically able to do both, then:

(1) In the presence of a notary and two competent witnesses, the testator shall declare or signify to them that the instrument is his testament and shall sign his name at the end of the testament and on each other separate page.

(2) In the presence of the testator and each other, the notary and the witnesses shall sign the following declaration, or one substantially similar: "In our presence the testator has declared or signified that this instrument is his testament and has signed it at the end and on each other separate page, and in the presence of the testator and each other we have hereunto subscribed our names this ____day of _________, ____." Art. 1578. When a testator knows how to sign his name and to read, and is physically able to read but unable to sign his name because of a physical infirmity, the procedure for execution of a notarial testament is as follows:

(1) In the presence of the notary and two competent witnesses, the testator shall declare or signify to them that the instrument is his testament, that he is able to see and read but unable to sign because of a physical infirmity, and shall affix his mark where his signature would otherwise be required; and if he is unable to affix his mark he may direct another person to assist him in affixing a mark, or to sign his name in his place. The other person may be one of the witnesses or the notary.

(2) In the presence of the testator and each other, the notary and the witnesses shall sign the following declaration, or one substantially similar: "In our presence the testator has declared or signified that this is his testament, and that he is able to see and read and knows how to sign his name but is unable to do so because of a physical infirmity; and in our presence he has affixed, or caused to be affixed, his mark or name at the end of the testament and on each other separate page, and in the presence of the testator and each other, we have subscribed our names this _____day of ____, _____." Art. 1579. When a testator does not know how to read, or is physically impaired to the extent that he cannot read, whether or not he is able to sign his name, the procedure for execution of a notarial testament is as follows:

(1) The written testament must be read aloud in the presence of the testator, the notary, and two competent witnesses. The witnesses, and the notary if he is not the person who reads the testament aloud, must follow the reading on copies of the testament. After the reading, the testator must declare or signify to them that he heard the reading, and that the instrument is his testament. If he knows how, and is able to do so, the testator must sign his name at the end of the testament and on each other separate page of the instrument.

(2) In the presence of the testator and each other, the notary and witnesses must sign the following declaration, or one substantially similar: "This testament has been read aloud in our presence and in the presence of the testator, such reading having been followed on copies of the testament by the witnesses [, and the notary if he is not the person who reads it aloud,] and in our presence the testator declared or signified that he heard the reading, and that the instrument is his testament, and that he signed his name at the end of the testament and on each other separate page; and in the presence of the testator and each other, we have subscribed our names this ____day of ____, ______."

(3) If the testator does not know how to sign his name or is unable to sign because of a physical infirmity, he must so declare or signify and then affix his mark, or cause it to be affixed, where his signature would otherwise be required; and if he is unable to affix his mark he may direct another person to assist him in affixing a mark or to sign his name in his place. The other person may be one of the witnesses or the notary. In this instance, the required declaration must be modified to recite in addition that the testator declared or signified that he did not know how to sign his name or was unable to do so because of a physical infirmity; and that he affixed, or caused to be affixed, his mark or name at the end of the testament and on each other separate page.

(4) A person who may execute a testament authorized by either Article 1577 or 1578 may also execute a testament authorized by this Article. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

Art. 1580. A testator who knows how to and is physically able to read braille, may execute a notarial testament according to the following procedure:

(1) In the presence of a notary and two competent witnesses, the testator must declare or signify that the testament, written in braille, is his testament, and must sign his name at the end of the testament and on each other separate page of the instrument.

(2) In the presence of the testator and each other, the notary and witnesses must sign the following declaration, or one substantially similar: "In our presence the testator has signed this testament at the end and on each other separate page and has declared or signified that it is his testament; and in the presence of the testator and each other we have hereunto subscribed our names this ____day of _____, _____."

(3) If the testator is unable to sign his name because of a physical infirmity, he must so declare or signify and then affix, or cause to be affixed, his mark where his signature would otherwise be required; and if he is unable to affix his mark he may direct another person to assist him in affixing a mark, or to sign his name in his place. The other person may be one of the witnesses or the notary. In this instance, the required declaration must be modified to recite in addition that the testator declared or signified that he was unable to sign his name because of a physical infirmity; and that he affixed, or caused to be affixed, his mark or name at the end of the testament and on each other separate page.

(4) The declaration in the notarial testament in braille form must be in writing, not in braille. [Acts 1997, No. 1421, §1, eff. July 1, 1999]

Art. 1580.1. A. A notarial testament may be executed under this Article only by a person who has been legally declared physically deaf or deaf and blind and who is able to read sign language, braille, or visual English.

B. The notarial testament shall be prepared and shall be dated and executed in the following manner:

(1) In the presence of a notary and two competent witnesses, the testator shall declare or signify to them that the instrument is his testament and shall sign his name at the end of the testament and on each other separate page of the instrument.

(2) In the presence of the testator and each other, the notary and the witnesses shall then sign the following declaration, or one substantially similar: "The testator has signed this testament at the end and on each other separate page, and has declared or signified in our presence that this instrument is his testament, and in the presence of the testator and each other we have hereunto subscribed our names this __________ day of ____________, 2____ ."

C. If the testator is unable to sign his name because of a physical infirmity, the testament shall be dated and executed in the following manner:

(1) In the presence of a notary and two competent witnesses, the testator shall declare or signify by sign or visual English to them that the instrument is his last testament, that he is unable to sign because of a physical infirmity, and shall then affix his mark at the end of the testament and on each other separate page of the instrument.

(2) In the presence of the testator and each other, the notary and the witnesses shall then sign the following declaration, or one substantially similar: "The testator has declared or signified by sign or visual English that he knows how to sign his name but is unable to sign his name because of a physical infirmity and he has affixed his mark at the end and on each other separate page of this testament, and declared or signified in our presence that this instrument is his testament and in the presence of the testator and each other we have hereunto subscribed our names this ___________ day of ___________________, 2_____."

D. The attestation clause required by Subparagraphs B(2) and C(2) shall be prepared in writing.

E.(1) A competent witness for the purposes of this Article is a person who meets the qualifications of Articles 1581 and 1582, and who knows how to sign his name and to read the required attestation clause, and is physically able to do both. At least one of the witnesses to the testament shall also meet the qualifications of a certified interpreter for the deaf as provided for in R.S. 46:2361 et seq.

(2) The testator shall be given the choice of accommodation services afforded by the use of large print, braille, or a tactile interpreter. [Acts 1999, No. 745, §1, eff. July 1, 1999]

CHAPITRE 6 – DES ACTES DE DISPOSITION À CAUSE DE MORT

SECTION 1 – DES TESTAMENTS EN GÉNÉRAL

 Art. 1570. On ne pourra plus disposer pour cause de mort que par testament prévu par la loi. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999] → CC 1825, art. 1563.

Art. 1571. Le testament ne peut être fait par un mandataire pour le testateur. Pas plus ne peut-il être fait par plusieurs dans un même acte. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999]

Art. 1572. Sous réserve de dispositions expresses de la loi, les dispositions testamentaires commises au choix d'un tiers sont nulles. Le testateur peut déléguer à son exécuteur le pouvoir d'attribuer des actifs particuliers pour satisfaire un legs exprimé en valeur ou en quotité, y compris une part fractionnée.

Le testateur peut expressément déléguer à son exécuteur le pouvoir d'attribuer un legs à une ou plusieurs entités ou fiduciaires de fiducies organisées à des fins éducatives, caritatives, religieuses, ou autrement philanthropiques. Les entités ou fiducies peuvent être désignées par le testateur ou être laissées à la discrétion de l'exécuteur s’il y est autorisé. En outre, le testateur peut expressément déléguer à son exécuteur le pouvoir d'imposer des conditions à ces legs. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999]

Art. 1573. Le testament doit être passé dans les formes prescrites à peine de nullité absolue. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999] 

SECTION 2 – DE LA FORME DES TESTAMENTS

Art. 1574. Le testament ne peut être qu’olographe ou notarié. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999] 

Art. 1575. A. Le testament olographe est entièrement écrit, daté et signé de la main du testateur. Quoique la date puisse figurer à un endroit quelconque du testament, le testateur doit y apposer sa signature à la fin. Tout ce qui est écrit par le testateur après la signature n’invalide pas le testament et cet écrit peut être considéré par le juge, à sa discrétion, comme en faisant partie. Le testament olographe n'est assujetti à aucune autre condition de forme. La date est suffisamment indiquée si le jour, le mois et l'année sont raisonnablement déterminables eu égard aux informations données par le testament, à la lumière de preuves extrinsèques s'il y a lieu. 

B. Les ajouts et suppressions dans le testament n'ont d'effets que s'ils sont de la main du testateur. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999 ; loi de 2001, n° 824, §1]

Art. 1576. Le testament notarié est passé dans les formes prévues aux articles 1577 à 1580-1. [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999 ; loi de 1999, n° 745, §1, en vigueur le 1er juillet 1999]

Art. 1577. Le testament notarié est rédigé par écrit, daté et passé de la manière qui suit. Si le testateur sait signer, lire et est physiquement capable de faire les deux, alors :

1o En présence du notaire et de deux témoins compétents, le testateur leur déclare ou signifie que l'acte est son testament et y appose sa signature à la fin ainsi que sur toute autre page.

2o En présence du testateur et de chacun, le notaire et les témoins signent une déclaration disant en substance : « En notre présence le testateur a déclaré ou signifié que cet acte est son testament et y a apposé sa signature à la fin ainsi que sur toute autre page et, en la présence du testateur et de chacun, nous avons souscrit à l’acte en ce jour (date complète) ». Art. 1578. Lorsque le testateur sait signer et lire, et est physiquement capable de lire, mais non de signer en raison d’un handicap physique, le testament notarié est passé en la forme suivante : 

1o En présence du notaire et de deux témoins compétents, le testateur leur déclare ou signifie que l'acte est son testament, qu'il est capable de voir et de lire mais non de signer en raison d’un handicap physique. Il appose sa marque où la signature est autrement requise et, s’il ne le peut, il lui est loisible de demander à une autre personne de l'assister à cette fin, ou de signer à sa place. Cette autre personne peut être l'un des témoins ou le notaire.

2o En présence du testateur et de chacun, le notaire et les témoins signent une déclaration disant en substance : « En notre présence le testateur a déclaré ou signifié que c'est son testament, qu'il sait voir, lire et signer, mais qu’il ne le peut en raison d'un handicap physique ; et en notre présence, il a apposé ou fait apposer sa marque ou son nom à la fin du testament et sur toute autre page, et en la présence du testateur et de chacun, nous avons souscrit à l’acte en ce jour (date complète) ». Art. 1579. Lorsque le testateur ne sait pas lire est physiquement incapable de lire, qu’il soit ou non en mesure de signer, le testament notarié est passé en la forme suivante :

1o Il doit être donné lecture du testament écrit à haute voix en présence du testateur, du notaire et de deux témoins compétents. Les témoins, et le notaire s’il ne donne pas lecture du testament à haute voix, doivent suivre la lecture sur des copies du testament. Après la lecture, le testateur leur déclare ou leur signifie l’avoir entendue et que l'acte est son testament. S’il sait comment et en est capable, le testateur appose sa signature à la fin du testament et sur toute autre page de l'acte.

2o En présence du testateur et de chacun, le notaire et les témoins signent une déclaration disant en substance : « Il a été fait lecture de ce testament à haute voix en notre présence et celle du testateur, et elle a été suivie sur des copies du testament par les témoins [et le notaire s’il n’a pas lu à haute voix] et, en notre présence, le testateur a déclaré ou signifié qu'il a entendu la lecture, que l'acte est son testament et qu'il y a apposé sa signature à la fin et sur toute autre page ; en la présence du testateur et de chacun, nous avons souscrit à l’acte en ce jour (date complète) ».

3o Lorsque le testateur ne sait pas signer ou ne peut le faire en raison d'un handicap physique, il doit le déclarer ou le signifier. Il doit ensuite apposer ou faire apposer sa marque là où sa signature est autrement requise ; et s’il ne le peut, il lui est loisible de demander à une autre personne de l'assister à cette fin, ou de signer à sa place. Cette autre personne peut être l'un des témoins ou le notaire. En ce cas, la déclaration requise doit être modifiée pour préciser en outre que le testateur a déclaré ou signifié qu'il ne savait pas signer ou ne le pouvait en raison d'un handicap physique, et qu'il a apposé ou fait apposer sa marque ou son nom à la fin du testament et sur toute autre page.

4 o La personne pouvant passer un testament autorisé par l'article 1577 ou 1578 peut également passer un testament autorisé par le présent article. [Loi de 1997,  no 1421, §1, en vigueur le 1er juillet 1999]

 Art. 1580. Le testateur qui sait lire le braille et est physiquement apte à le faire peut passer le testament notarié dans la forme suivante :

1o En présence du notaire et de deux témoins compétents, le testateur déclare ou signifie que le testament rédigé en braille est son testament, et y appose sa signature à la fin et sur toute autre page de l'acte.

2o En présence du testateur et de chacun, le notaire et les témoins signent une déclaration disant en substance : « En notre présence le testateur a apposé sa signature à la fin de ce testament et sur toute autre page, et a déclaré ou signifié qu'il s'agit de son testament. En présence du testateur et de chacun, nous avons souscrit à l’acte en ce jour (date complète) ».

3o Si le testateur ne peut signer en raison d'un handicap physique, il le déclare ou signifie puis appose ou fait apposer sa marque là où sa signature est autrement requise. S'il ne peut apposer sa marque, il lui est loisible de demander à une autre personne de l'assister à cette fin ou de signer à sa place. Cette autre personne peut être l'un des témoins ou le notaire. En ce cas, la déclaration requise doit être modifiée pour préciser en outre que le testateur a déclaré ou signifié qu'il ne pouvait pas signer en raison d'un handicap physique, et qu'il a apposé ou fait apposer sa marque ou son nom à la fin du testament et sur toute autre page.

4o La déclaration dans le testament notarié en braille doit être faite par écrit et non en braille.  [Loi de 1997, n° 1421, §1, en vigueur le 1er juillet 1999]

Art. 1580-1. A. Le testament notarié peut être passé selon le présent article uniquement par celui qui a été légalement déclaré physiquement sourd ou sourd et aveugle, et qui peut lire la langue des signes, le braille ou l'anglais visuel.   

B. Le testament notarié est rédigé, daté et passé dans la forme suivante :

1o En présence du notaire et de deux témoins compétents, le testateur leur déclare ou signifie que l'acte est son testament et y appose sa signature à la fin ainsi et sur toute autre page de l'acte.

2o En présence du testateur et de chacun, le notaire et les témoins signent ensuite la déclaration disant en substance : « Le testateur a apposé sa signature à la fin de ce testament et sur toute autre page, et a déclaré ou signifié en notre présence que l'acte est son testament. En présence du testateur et de chacun, nous avons souscrit à l’acte en ce jour (date complète) ».

C. Lorsque le testateur ne peut signer en raison d'un handicap physique, le testament est daté et passé dans la forme suivante :

1o En présence du notaire et de deux témoins compétents, le testateur leur déclare ou signifie par signe ou anglais visuel que l'acte est son dernier testament, qu'il ne peut signer en raison d'un handicap physique puis appose sa marque à la fin du testament et sur toute autre page de l'acte.

2o En présence du testateur et de chacun, le notaire et les témoins signent ensuite une déclaration disant en substance : « Le testateur a déclaré ou signifié par signe ou anglais visuel qu'il sait signer, mais ne peut le faire en raison d'un handicap physique, et qu'il a apposé sa marque à la fin et sur toute autre page du testament. Il a déclaré ou signifié en notre présence que l'acte est son testament. En présence du testateur et de chacun, nous avons souscrit à l’acte en ce jour (date complète) ».

D. La clause d'attestation requise aux alinéas B.2o et C.2o doit être préparée par écrit.

E.1o Le témoin compétent aux fins du présent article est une personne qui possède les qualifications prévues aux articles 1581 et 1582, qui sait signer et lire la clause d'attestation requise et est physiquement apte à faire les deux. Au moins l'un des témoins du testament doit également posséder les qualifications d'un interprète certifié en langage des signes, tel que prévu par les articles R.S. 46:2361 et suivants des Revised Statutes*.

2o Parmi les services proposés, le testateur a le choix entre les gros caractères, le braille ou l'interprète tactile. [Loi de 1999, n° 745, §1, en vigueur le 1er juillet 1999]
